UNITED STATES v. NORTH

February 17, 1989

UNITED STATES OF AMERICA
v.
OLIVER L. NORTH

Gerhard A. Gesell, United States District Judge.

The opinion of the court was delivered by: GESELL

GERHARD A. GESELL, UNITED STATES DISTRICT JUDGE

Alternate juror number 3, Tanya Saneya Mitchell has through her counsel asked the Court to conduct today's hearing concerning her availability to be sworn in private. At the hearing, she will be required to discuss events occurring in her presence at work which give her concern, and which could affect her relationship with her fellow employees. After conferring informally with the juror's counsel and thereafter with counsel for the parties, the court finds no alternative and that closure at this stage is necessary to protect her privacy interests and finds that closure will likely encourage candid answers to question from the Court and counsel and thus aid the administration of justice.

 Accordingly, it is hereby

ORDERED that today's proceedings regarding alternate juror number 3 shall be closed.
