ORDER

On consideration of appellant's petition for rehearing, it is

ORDERED that the second sentence of footnote 2 of this court's opinion filed on August 9, 1990, is amended to read as follows:

Nor did he request that the September 29 trial be postponed until September 28, when he filed a lengthy memorandum opposing the fee request on various grounds. On the first page of that memorandum he asserted for the first time that he should not be "forced to try this case" on September 29 on the fee issue, even though it had been made clear by the court at the July 10 hearing that attorney's fees would be at issue in the September 29 trial.

It is FURTHER ORDERED that in all other respects the petition for rehearing is denied.
