Andrew M. Franklin appeals from the August 25, 1998, order of the United States Court of Federal Claims denying his application to proceed in forma pauperis and dismissing his complaint. Mr. Franklin's complaint was dismissed in part for want of jurisdiction under Rule 12(b)(1) of the Rules of the Court of Federal Claims, and in part under Rule 12(b)(4) of the Court of Federal Claims for failure to state a claim upon which relief could be granted.
