ORDER DISMISSING THE ROCHE DEFENDANTS WITH PREJUDICE
This matter being presented to the Court in connection with the unopposed motion of plaintiff Bristol-Myers Squibb Company ("BMS") to dismiss Roche Vitamins Inc., Hoffmann-La Roche Inc., and F. Hoffmann-La Roche Ltd. (collectively, the "Roche Defendants") with prejudice,
IT IS HEREBY ORDERED that the Complaint in this action is dismissed with prejudice solely against the Roche Defendants. This Order is without prejudice to BMS' claims against any other defendant or alleged co-conspirator in the above-captioned case.
IT IS SO ORDERED.
