ORDER GRANTING NUTRA-BLEND L.L.C.'S MOTION TO DISMISS
DEFENDANTS LONZA AG, LONZA INC., DEGUSSA AG (fka DEGUSSA-HULS AG),
DEGUSSA CORPORATION (aka DEGUSSA-HULS INC.), REILLY CHEMICALS S.A.,
REILLY INDUSTRIES, INC., AND NEPERA, INC.
This matter being presented to the Court in connection with the unopposed motion of Plaintiff Nutra-Blend L.L.C. to Lonza AG, Lonza Inc., Degussa AG (fka Degussa-Huls AG), Degussa Corporation (aka Degussa-Huls Inc.), Reilly Chemicals S.A., Reilly Industries, Inc., and Nepera, Inc.,
IT IS HEREBY ORDERED that the Second Amended Complaint in this action is dismissed with prejudice solely as to Lonza AG, Lonza Inc., Degussa AG (fka Degussa-Huls AG), Degussa Corporation (aka Degussa-Huls Inc.), Reilly Chemicals S.A., Reilly Industries, Inc., and Nepera, Inc., each party to bear its own costs. This Order is without prejudice to Plaintiff Nutra-Blend L.L.C.'s claims against any other Defendant or alleged co-conspirator in the above-captioned case.
IT IS SO ORDERED.
