ORDER GRANTING THE PLAINTIFFS' MOTION TO AMEND THEIR FIRST AMENDED COMPLAINT; DENYING WITHOUT PREJUDICE ALL PENDING MOTIONS PERTAINING TO THE FIRST AMENDED COMPLAINT; AND ORDERING FURTHER BRIEFING ON THE REMAINING OUTSTANDING ISSUES

For the reasons stated in this court's Memorandum Opinion separately and contemporaneously issued this 15th day of July, 2003, it is hereby

ORDERED that the plaintiffs' motion [#75] to amend their first amended complaint is GRANTED; and it is

FURTHER ORDERED that by July 23, 2003, the plaintiffs file a second amended complaint; and it is

ORDERED that all pending motions [#52, 54] pertaining to the first amended complaint are DENIED without prejudice; and it is

FURTHER ORDERED that by August 18, 2003, in light of the amendments made by the second amended complaint and in keeping with this court's previous memorandum opinion,*fn1 each party submit a brief, not to exceed seven pages double-spaced, setting forth the party's views on (1) the definition of the class, (2) the naming of class representatives, (3) the manner by which notice should be given to class members, (4) the ability of class members to opt out of the class, and (5) the need, if any, to add additional plaintiffs.*fn2
