ORDER

This matter is set for argument on petitioner's motion for a preliminary injunction or temporary restraining order on December 7, 2004 at 10:00 a.m. In view of some of the matters raised in petitioner's reply in support of his motion for preliminary injunction, the Court wishes to make clear that the only issue it wishes to consider at oral argument is whether petitioner is entitled to an injunction preventing his removal from the United States. Whether his detention is legitimate at all is a question for another day, as are issues relating to the preservation of evidence, procedures governing communications between petitioner and counsel, and the assignment of counsel under the Criminal Justice Act. These are matters the Court will transfer to Judge Joyce Hens Green for coordination and decision.
