The opinion of the court was delivered by: COLLEEN KOTELLY, District Judge
For the reasons stated in the accompanying Memorandum Opinion,
ORDERED that defendants' third motion for partial summary
judgment [# 37] is GRANTED in part and DENIED in part without
prejudice. The motion is granted with respect to Counts 1-8,
10-13, 38-41, 43, 45 and parts of Counts 42 and 46 of the
complaint. Defendants' motion is DENIED without prejudice with
respect to Counts 9 and 44 and Count 42 to the extent of the
Bureau of Prisons's exemption 7(C) claim and Count 46 to the
extent of the adequacy of the Bureau of Prisons' search for
investigative records; and it is
FURTHER ORDERED that within thirty (30) days of this Order,
defendants shall supplement the record with a memorandum and
supporting evidence that addresses the Court's concerns raised in
the accompanying Memorandum Opinion, release to plaintiff any
non-exempt records and, if appropriate, renew their dispositive
